1. CONSTITUTIONAL FRAMEWORK
In accordance with Article 7, section b) of the Political Constitution
of the State of 1967: ?Every person has the right ?to express freely
his ideas and opinions, by any medium.?1
Article 15 of the Constitution expresses: ?The public officials
who, without a state of siege in force, persecute, confine or exile
citizens, and those who close printing shops or other means of expression
of thought, and commit depredations and other abuses, are subject
to paying damages, provided it is proved that such measures or facts
were adopted in violation of the rights and guarantees established
by the Constitution. The civil case to prove damages can be brought
to court independent of the pertinent criminal action proceeding.?

Article 112 states: ?The declaration of a state of siege produces
the following effects:
3. The guarantees and
rights consecrated by this Constitution shall not be suspended as
a result of a mere declaration of the state of siege; but they may
be suspended for certain persons fundamentally accused of plotting
against public order, in accordance with what is established in
the following paragraphs.
6. In the case of international
war, censorship of correspondence and all publishing media may be
established.? 3
