21. REGULATION
OF DISTRIBUTION OF NEWSPAPERS, MAGAZINES OR PUBLICATIONS
Among other restrictions of distribution or circulation of
publications is the one mentioned in Article 60 of the Press Law
of 1967, which says, Newspapers, periodicals, books and any other
printed matter published abroad have free entry into Brazil.
§1. The terms of this Article shall not apply to printed matter
that contains any violation mentioned in Articles 15 and 16, whose
entry into the country may be banned for up to two years by order
of a judge or the Minister of Justice and Interior Affairs, the
paragraphs of Article 63 being applicable in this case.
§2. Anyone selling, putting up for sale or distributing newspapers,
periodical publications, books or printed matter whose entry into
the country has been prohibited under terms of the foregoing paragraph,
in addition to losing the material shall incur a fine of up to Cr$10,000.00
(ten thousand cruzeiros) per copy seized, to be imposed by the relevant
judge as part of the seizure order. Before ruling, the judge shall
hear the accused within 48 hours.
§3. Exempted from the terms of §§ 1 and 2 of this Article are
scientific, technical, cultural and artistic publications.
