8. RIGHT TO A GOOD NAME, TO PRIVACY, TO OWN IMAGE

There is no clear legal definition of the right to good name or privacy in civil law. However, Article 5 item X of the Constitution states that punitive damages may be awarded when intimacy, privacy, good name or own image of persons is violated. The damages that may be obtained by civil action for defamation or slander are set out in the Civil Code, whose Article 1547 states that indemnity in the case of slander or libel shall consist of payment of damages resulting from it to the offended party.
