SPECIFIC PRESS LAWS
Criminal
libel and laws regarding hate literature, obscenity and child pornography
are governed by federal law in the criminal code. The criminal code
also contains provisions for publication bans, including bans on
the identity of complainants in sexual assault matters. Copyright
is governed by the federal Copyright Act. Access to government information
is regulated through federal, provincial and municipal statutes.
Although some provinces have statutes protecting the right of privacy,
the protection of privacy is largely governed by common law. Laws
respecting defamation arise from the common law and from provincial
statutes. Every province has a defamation statute the provisions
of which are substantially similar. The regime of laws affecting
the media differs in some respects in the province of Quebec, which
is governed by civil law rather than common law.
