19. ANTITRUST LAWS LIMITING CAPITAL
CONCENTRATION IN THE PRINT MEDIA
There is no antitrust requirement that refers specifically
to the media. Article 130 of the Political Constitution establishes
that: ?Monopolies and privileges are forbidden. The State shall
limit the operations of companies that tend to control, in detriment
to the national economy, the production in one or more industrial
sectors or of the same commercial or agricultural and cattle raising
activities. Matters relating to this shall be regulated by law.
The State shall protect the market economy and shall block the way
of associations that tend to restrict freedom of the market or which
harm consumers.? 98
Likewise, the Commercial Code and the Penal Code include norms
that forbid the formation of monopolies. 99
