19. ANTITRUST LAWS LIMITING CAPITAL
CONCENTRATION IN THE PRINT MEDIA
Article 38: ?Any practice that limits or distorts competition
is forbidden.
?Practices that restrict competition include agreements between
companies that render telecommunication services that have the objective
of distributing the market between them, of setting the same or
similar prices or fees although costs may be different, of limiting
access to this activity to potential competitors, and any other
practices determined by CONATEL.
?In order for a practice to be determined as restrictive of
competition it shall suffice that the agreements reached are susceptible
of causing the stated effects and that they confer the counterpart
a discriminatory preference over their competitors, or that it implies
abuse of a dominating position to gain market advantage.?d96
Article 158: ?In all the fields to which this law refers, it
is absolutely forbidden to engage in relationships that may be considered
monopolistic.? 97
