1. CONSTITUTIONAL FRAMEWORK

Jamaica became independent in 1962, adopting a written Constitution which contains no specific provision concerning the press.

However, chapter III subtitled ?Fundamental Rights and Freedoms,? includes Section 22 which begins in Subsection 1. ?Except with his own consent no person shall be hindered in the enjoyment of his freedom of expression.??

This is interpreted to be inclusive of a constitutional guarantee of freedom of the press although the press or media is not specifically mentioned. There are however, other statutes which balance this freedom with responsible journalism. Such laws deal with defamation, pornography, threats to national defense, sedition and treason and public safety.
