12. PROFESSIONAL SECRECY OR PROTECTION
OF SOURCES
There is no legislation referring expressly and in concrete
terms to professional secrecy for journalists.
However, this right is interpreted as being implicitly enshrined
in Article 46 of the Constitution, which gives effect to international
treaties on human rights and freedom of expression.
The Penal Code, in the chapter on ?Disclosure of Secrets,?
says in Article 104: ?Those lawyers, notaries public, doctors, surgeons,
midwives and others who reveal secrets confided in them by reason
of their profession shall be suspended for one to two years and
be fined from 25 to 200 córdobas, except in those cases where they
are required to make such disclosures under the law.?
