4. STATUS OF INTERNATIONAL TREATIES IN NATIONAL LAW

The Political Constitution establishes the precedence with respect to international treaties:

Art. 145: ?No treaties may be ratified that restrict or affect in any way constitutional provisions, unless the ratification is done with the corresponding reservations. The provisions of the treaty that are subject to reservations are not the law of the Republic.?

Art. 146: ?No treaties may be negotiated or ratified or concessions made that in any way alter the type of government or harm or undermine the integrity of the territory, the sovereignty and independence of the Republic or the rights and fundamental guarantees of the human being.

The aforementioned applies to international treaties or contracts with governments or with national or international companies whereby the Salvadoran state submits to the jurisdiction of a court in a foreign nation.??
