12. PROFESSIONAL SECRECY OR PROTECTION OF SOURCES

The Press Law, Law 16,099, Article 1, Paragraph 3, states: ?Journalists shall have the right to seek protection in professional secrecy regarding sources of the news that they relay in the news media.?

The Penal Code?s Article 302 stipulates: ?He who without just cause reveals secrets that may have come to his knowledge by reason of his profession, employment or commission, in the event that it is injurious shall receive punishment of a fine of 100 to 2,000 pesos.?

In practice, this clause means that journalists do not lose the protection of professional secrecy.
