21. REGULATION OF DISTRIBUTION OF NEWSPAPERS, MAGAZINES OR PUBLICATIONS

A contentious and important economic issue for newspaper companies in recent years is whether a municipality can restrict newspaper vending machines on public property. Courts have answered that question in the affirmative, so long as the local law limiting news racks is equipped with procedures to keep it from being administered arbitrarily. For example, a court is likely to uphold a local ordinance if, for safety and aesthetic reasons, it prohibited all news racks on the city?s main street or near an intersection.
