12. PROFESSIONAL SECRECY OR PROTECTION OF SOURCES

The National Constitution refers to this institution in Article 43, third paragraph, when it expresses: ?Any person can file a motion to gain knowledge of information about him which appears in public records and data banks, or in private ones used to provide information; and in the event they are false or discriminatory, can demand their suppression, correction, confidentiality or updating. The secrecy of the sources of journalistic information shall not be affected.?43

Thus a necessary balance between access to information and the confidentiality of the journalistic sources is attained, guaranteeing the legal effect of freedom of expression.
