21. REGULATION OF DISTRIBUTION OF NEWSPAPERS, MAGAZINES OR PUBLICATIONS

 The executive branch implemented a statutory scheme of deregulation of the commercialization process of newspapers and magazines in 1999. The Ministry of Economy issued Resolution No. 416 of 1999 and repealed the old system in effect since 1945 that permitted the sole distribution by members of the street vendors union. The new deregulatory scheme, not yet in effect, allows newspapers and magazines to utilize any adequate means of distribution, including street vendors.

The old legal scheme imposed upon the newspapers and magazines the obligation of accepting the return of unsold issues and, in such case, to reimburse the distributors and vendors for the sums received for those issues. The Ministry of Labor recognized the right to the stability of the vendors? location of sale. The Ministry was responsible for determining the days in which there would be no sale of newspapers and magazines.
