4. STATUS OF INTERNATIONAL TREATIES IN NATIONAL LAW

All international treaties approved by Congress, regardless of content, are of greater hierarchy than the laws. A treaty repeals, expressly or implicitly, any law or norm of lower hierarchy that opposes its content. On the other hand, a subsequent law cannot repeal a treaty.

By virtue of numerals 22 and 24 of Article 75, a hierarchical scale foreseen in Article 31 of the Constitution is as follows: a) National Constitution. b) Human rights treaties approved by Congress with the vote of two thirds of the total members of each Chamber. c) The treaties of integration. d) The remaining international treaties. e) The Congressional laws.20
