RIGHT OF REPLY AND OF RETRACTION
The
provincial defamation statutes provide for a limited right of reply
in circumstances in which the defendant wishes to rely on the defense
of absolute privilege. That defense will not apply if the defendant
has refused to publish a ?reasonable statement of explanation or
contradiction by or on behalf of the plaintiff.? Otherwise, there
is no right of reply in Canada. However, the provincial defamation
statutes and the common law encourage the publication of retractions
and apologies in the interest of mitigating damages, and it is common
practice of the responsible media to publish corrections where warranted.
