COPYRIGHT IN NEWSPAPERS
Copyright
in Canada is governed by federal legislation which provides, without
the need for any registration, that copyright is automatically created
in an original work and is owned by the author of the work unless
the copyright is assigned in writing or the work is created on behalf
of an employer. Therefore, a media company owns the copyright of
the work produced by its employees, but does not own the copyright
of work created by freelance contributors. The owner of the copyright
has the sole right to make any use of the copyrighted material.
However, the Copyright Act provides a special right to newspaper
employees which enables them to prevent the subsequent use of work
they have produced. This special right does not change the fact
that the copyright is owned by the newspaper and therefore does
not create any right of the employee to use the work.
