2. SPECIFIC PRESS LAWS

In Chile there is a law which specifically regulates the press, as well as all other communication media, called the Law on Advertising Abuses. 18  

This law stipulates that ?the publication of opinions via print and, in general, the public broadcasting via any medium of the verbal or written word is not subject to prior authorization or censorship.? 19

Article 19, Numeral 12, of the Political Constitution of the State guarantees all the inhabitants of the Republic the right to not be persecuted for their opinions, and can investigate and receive information, as well as disclose them without limitation of borders and via any means of expression. The abuse of this right can only be punished in the cases and forms stipulated by this law. 20

Article 9 states: ?The person who consents to appearing as director without being so and the person, in such case, who is the actual director, shall incur a lesser form of incarceration.

?The weighing of the circumstances shall be done in all consciousness by the corresponding court.? 21

Article 10 orders: ?The responsibility for the administrative violations foreseen in this section shall lapse six months after they have been committed.? 22

There are, however, various regulations on the freedom of speech, both in the Code of Military Justice and the Law of State Security, which shall be addressed later.
