1. CONSTITUTIONAL FRAMEWORK

The Constitution of 1991 introduced major changes on fundamental rights. It provides, among others, for the right to information, the right to retraction, the right to good reputation, the right to establish information media, and the prohibition of censorship.

Art. 15: ?All individuals shall have the right to personal and family privacy and the right to good reputation, and the State shall respect these rights and enforce respect for them. Individuals shall also have the right to know, update and rectify information about themselves contained in data banks and archives of public and private entities.

Freedom and other guarantees embraced in the Constitution shall be respected in the compilation, processing and circulation of data. Correspondence and other forms of private communication shall be inviolable. They may intercepted or registered solely by judicial order according to actions and formalities prescribed by law.

For tax or judicial purposes, as well as for inspection, surveillance and intervention by the State, the authorities shall demand the presentation of accounting ledgers and other private documents in the terms prescribed by law.

Art. 16 ? ?All individuals have the right to develop their personality freely with no limitations besides those imposed by the rights of others and the legal system.?

Art. 20: ?Everyone is guaranteed the right to express and disseminate their thoughts and opinions, freedom to inform and receive truthful and impartial information, and freedom to establish mass communcation media.?

Mass communcation media are free and shall exercise social responsibility. The right to retraction is guaranteed in conditions of equity. There shall be no censorship.?

Art. 21: ?The right to good reputation is guaranteed. The law shall prescribe how it is to be protected.?

Art. 73: ?The exercise of journalism shall be protected in order to guarantee its professional freedom and independence.?

Art. 74:?Everyone has the right to access to public documents except in cases prescribed by law.

Professional secrecy is inviolable.?
