8. RIGHT TO A GOOD NAME, TO PRIVACY,
TO OWN IMAGE
Law 94 of 1997 substantially amended the Penal Code regarding
sanctions for conduct that interferes with the private lives of
persons through the recording, interception or publication of their
communications or images (Arts. 337, 337.1 and 338).
Art 337 addresses the intentional attempt against the privacy
of individuals and establishes sanctions ranging from six months
to one year. To attempt against the privacy of an individual is
defined as the transmission or interception of words communicated
confidentially without the consent of the individual, or the transmission
and recording of the image of an individual in a private place without
the individual?s consent.
Art. 338 establishes sanctions for whoever publishes by any
means a montage of the words or images of an individual without
his or her consent, if it is not evident that it is a montage and
there is no express mention of that fact. The punishment for this
crime is a prison term of one to two years and fines of from RD$1,000
to RD$100,000.
