5. SPECIAL JUDICIAL STRUCTURE FOR
THE PRESS
The Code of Penal Procedure RO 511 of June 10, 1983 provides
for a special process to deal with crimes committed by means of
the various news media. This implies an exception to the procedural
principle of the equality of criminals. Section Two of Title VI
of Book Four, Paragraph One of the cited code, contains special
rules for trying offenses committed by the news media as indicated
in Article 415: ?in trying crimes committed by the press, radio
and television stations and other news media, rules appropriate
to ordinary proceedings shall apply, as well as the special rules
contained in this paragraph.?
In effect, Article 417 of the Code of Penal Procedure notes
that: ?For the purposes noted in this paragraph, regarded as immoral
will be any writing that attacks good behavior, whether it be through
obscenity or dishonesty, or by publishing prurient facts about the
personal life of some persons, or by instigating the commission
of some crime.?
