14. PUBLIC INFORMATION AND ACCESS TO GOVERNMENT INFORMATION

The Political Constitution contains two provisions regarding access to public records. The first says:

Article 8: ?Public officials and employees shall respect the right to request information, so long as it is submitted in writing, peacefully and respectfully; but where political material is involved, only citizens of the Republic may use this right.

?Any request must be supported by written agreement of the authority to which it is addressed, which has the obligation of responding promptly to the petitioner.?

As there has been no enabling legislation on the right of access to information, there is no way of applying this right to government information.

However, for a better understanding of the matter within the Mexican context, refer to the section on jurisprudence to see the court ruling on the final Paragraph of Article 6 of the Political Constitution which stipulates that the state shall guarantee the right to information. The court has ruled that the government shall issue regulations regarding access to public records, but it has yet to do so.
