14. PUBLIC INFORMATION AND ACCESS TO GOVERNMENT INFORMATION

Article 2, Section 5, of the Constitution establishes that every person has the right ?to request any information he requires and to receive it from any public entity, within the legal timeline and at the cost the request incurs. Excluded is any information that affects personal privacy and which is expressly excluded by law or for national security reasons.? Meanwhile, Section 6 states that every person has the right ?for informational services, whether computerized or not, public or private, not to provide information that may affect personal and family privacy.?

With the Constitutional Reform the definition of Habeas Data was introduced, as expressed in Article 200, which states that this right may be exercised with respect to the rights contained in Sections 5 and 6 of said article of the Constitution. The first one refers to the possibility of requesting information from the authorities and of receiving their reply within the legal timeline (Article 2, Section 5). The second one bans the informational services from supplying or disclosing information related to personal or family privacy (Article 2, Section 6).
