18. REGULATION OF FOREIGN OWNERSHIP OF PUBLICATIONS

Article 71 of the Constitution states that: ?Regarding ownership of property, foreign nationals, whether individuals or corporations, have the same status as the Peruvians, and may not, in any case, invoke exception or diplomatic protection.?

Apparently Decree 702 of 1991, which mandated (Article 23) that only Peruvian nationals could offer telecommunications services, was amended by the Telecommunications Law of 1993, as said provision was not included. However, due to recent developments in connection with the expropriation of a television channel in 1997 owned by a foreign national, this conclusion is not completely certain.
