21. REGULATION OF DISTRIBUTION OF NEWSPAPERS, MAGAZINES OR PUBLICATIONS

There is no specific law or regulation in this respect.

With respect to newspaper distributors, Article 1790 and subsequent articles of the Civil Code, which regulate ?atypical? contracts, are applied as supplementary, as well as Article 237 and subsequent articles of the Commercial Code when addressing a mercantile commission.

With respect to newspaper street vendors, Law 10,674 of October 5, 1946, established that it was a function of the State to protect and assist newspaper and magazine street vendors. Article 80 of this law states: ?The interference of intermediaries between the publishing firms and charitable associations and the street vendors of newspapers and lottery is prohibited.? Not included in this provision are the direct agents of newspapers and lottery that ?are published and sent to a place other than its retail shops.?

It is mandatory for newspaper companies headquartered in Lima that publish a morning newspaper to provide their street vendors daily breakfast, while those that publish an evening newspaper to provide them with daily tea service.
