4. STATUS OF INTERNATIONAL TREATIES IN NATIONAL LAW

Article 55 of the Constitution establishes: ?The treaties entered into by the State and that are in force are part of national law.?

Therefore, the provisions related to the press that are part of the text of the Universal Declaration of Human Rights and of the Inter-American Commission on Human Rights of the Organization of American States, approved by the State, constitute laws of the Republic and are of mandatory compliance.

In addition, with reference to international jurisdiction, Article 205 of the Constitution establishes: ?Once internal legal recourse has been depleted, anyone who considers he has been harmed in his constitutional rights may petition the international tribunals or organizations, in accordance with treaties and agreements of which Peru is a part.?
