9. OTHER RESTRICTIONS ON THE CONTENT
OF INFORMATION
Art. 73 of the Code of Criminal Procedure assigns a confidential
classification to the instruction or preliminary discovery phase
in criminal cases. The rule states that a judge may order that an
action be kept confidential for a determined period of time if it
is judged that disclosure could hamper the investigation or its
outcome.
Art. 74 of Decree Law No. 26102 of the Minors and Adolescents
Code bans the news media from publishing the identity of a minor
involved in a crime or witness to a violation. The same statute
provides for sanctions for the publication of information or investigation
secrets involving minors or adolescents.
Art. 191 of the Organic Law of Elections No. 26,859, prohibits
the publication of polls or forecasts of any sort about the results
of elections by the news media during 15 days prior to the election.
Failure to comply can lead to fines that are determined by the National
Elections Board.
