19. ANTITRUST LAWS LIMITING CAPITAL CONCENTRATION IN THE PRINT MEDIA

Volume 47 of the Federal Regulatory Code (CFR) S. 73.35555 deals with regulation of concentration of media ownership in the same market. The policy applied is the same as laid down by the Federal Communications Commission (FCC). There is a ban on one person owning a newspaper and a radio station in the same market (S. 73.3555(a)(1) (1994). The same rule applies in the case of English-language newspapers (Paragraph 6 of the above-mentioned rule).

The anti-trust provisions of the Federal Anti-Monopoly Laws are not applicable to newspapers. S. 48 of Volume 48 of the Federal Code of Regulations provides for a special procedure for asking the attorney general for permission to carry out joint ventures. Although these are not monopolies, the prohibition stipulated in Chapter 13 of the Trade Code applies.
