1. CONSTITUTIONAL FRAMEWORK

The National Constitution of 1967, in effect since February that year (amended on August 24, 1966, and passed the following November) in Section II on ?Rights, duties and guarantees? stipulates in Article 29: ?The communication of thought by word, in private writings or published in the press or by any other means of dissemination is entirely free in every respect, without need for prior censorship, the author and, as applicable, the printer or broadcaster, being responsible under the law for any abuses that may be committed.?

According to Article 72, ?The enumeration of rights, duties and guarantees set out in the Constitution does not exclude the others that are inherent in human nature or that derive from the republican form of government.?

Those rights relating to individuals and the powers and duties of the authorities not mentioned in the Constitution will not stop being applied through lack of enabling legislation but will substituted by the bases of analogous laws, the general principles of law and the doctrines generally accepted as a result of what is set out in Article 333 of the Constitution.
