EL SALVADOR

WHEREAS
judges have taken it upon themselves to subpoena journalists to appear for trials and off-the-record hearings, and to make witness statements, even though they have not been eyewitnesses or earwitnesses to any crime whatsoever

WHEREAS
the judge for the First Criminal Court for Sentencing of San Salvador, Saúl Ernesto Morales, issued a threatening subpoena to a journalist, and was considering the possibility of using law enforcement, arrest and trial should the journalist fail to appear

Principle 3 of the Declaration of Chapultepec states, "The authorities must be compelled by law to make available in a timely and reasonable manner the information generated by the public sector. No journalist may be forced to reveal his or her sources of information"

THE GENERAL ASSEMBLY OF THE IAPA RESOLVES

to urge the Salvadoran Congress to amend the Code of Criminal Procedure to include journalists in the category of those professions exempt from having to testify.
